These Terms of Service ("Terms") govern your access to and use of the peer-to-peer encrypted file transfer and messaging application ("Service"). By installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
1. Description of the Service
The Service enables users to:
- •transmit files and folders directly to one another using peer-to-peer technology, and
- •exchange text messages, media, and other communication ("Messages") using encrypted communication channels.
Transfers and Messages are encrypted end-to-end where technically feasible. The Service does not store message content or file contents on central servers, except transiently and only if required for routing, delivery, or reconnection.
2. Eligibility
You must be the age of majority in your jurisdiction and have legal capacity to enter a binding agreement. If acting on behalf of an organization, you confirm you are authorized to bind that organization.
3. User Responsibilities
You agree to:
- •Use the Service only for lawful, non-abusive purposes.
- •Ensure you have rights to any files or content you send.
- •Not use the Service to transmit harmful, unlawful, infringing, harassing, or malicious material.
- •Avoid interfering with, modifying, or attempting to bypass any security, encryption, or rate-limiting systems.
- •Maintain secure devices, passwords, and access to your account or encryption keys.
You acknowledge that you are solely responsible for your Messages and files.
4. Content Ownership
You retain full ownership of your files, folders, and Messages. The provider does not claim ownership and does not monitor or view content except automatically and temporarily as needed for technical operation, such as message queuing, routing, or encryption key exchange.
5. Messaging Functionality
5.1 Nature of Messaging
The Service provides encrypted messaging between users, including but not limited to:
- •one-to-one chats
- •group messaging (if enabled)
- •text, media, and attachment exchanges
5.2 Encryption
Messages are encrypted end-to-end where supported. This means:
- •message content is intended to be readable only by intended recipients;
- •the provider cannot access message content;
- •some message metadata (e.g., timestamps, sender/receiver identifiers, routing details) may be processed for delivery and system functionality.
5.3 Message Delivery
Messages may be temporarily cached, encrypted, on servers solely to facilitate delivery when a recipient is offline. These temporary caches, if used, are automatically cleared after a short retention period.
5.4 User Responsibility for Messaging
You agree not to use messaging functionality to:
- •send spam, threats, hate speech, or harassment;
- •distribute malware or harmful links;
- •coordinate unlawful activity;
- •violate privacy, intellectual property, or data protection laws.
6. Encryption and Security
The Service is designed to protect your files and Messages using modern cryptographic methods. However:
- •absolute security cannot be guaranteed;
- •fallback relay servers or message queues may be required under certain network conditions;
- •you are responsible for protecting your device, keys, and passwords.
The provider is not liable for unauthorized access resulting from your failure to secure your device or credentials.
7. Unlimited File or Folder Size
The Service aims to support unlimited file and folder sizes. Real-world performance depends on device capability, network quality, and recipient conditions. Technical limits may be applied to maintain system integrity or prevent abuse.
8. Service Availability
The Service is provided on an "as-is" and "as-available" basis. Messaging and file transfers may experience delays, throughput variations, interruptions, or failures due to network or technical limitations.
The provider may modify, suspend, or discontinue features at any time.
9. Privacy
The Service collects minimal operational data such as connection metadata, crash logs, device information, and optional account details. Message content and file contents are not stored or analyzed, except transiently and only as needed for routing.
Personal data is handled in accordance with the Privacy Policy.
10. Prohibited Uses
You may not use the Service to:
- •violate intellectual property rights;
- •distribute illegal or harmful material;
- •harass, defraud, or harm others;
- •attempt unauthorized monitoring or surveillance;
- •disrupt the network or infrastructure.
Violations may result in termination.
11. Third-Party Software & Networks
The Service may rely on third-party libraries or network infrastructure. The provider is not responsible for failures, vulnerabilities, or changes introduced by such components or by the networks used for file transfer or messaging.
12. Updates
The Service may push automatic updates to maintain security and functionality. Continued use signifies acceptance of such updates.
13. Disclaimers
To the extent permitted by law:
- •the Service is provided without warranties of any kind;
- •no guarantee is made regarding security, performance, uptime, or error-free operation;
- •the provider is not responsible for message delivery failures, delays, corruption, or data loss.
14. Limitation of Liability
To the maximum extent permitted by law:
- •the provider will not be liable for indirect, incidental, special, or consequential damages;
- •total liability for any claim will not exceed the amount paid for the Service in the preceding 12 months (or $0 for free services).
Some jurisdictions do not allow certain limitations and exceptions may apply.
15. Indemnification
You agree to indemnify and hold harmless the provider and its affiliates from any claims arising from:
- •your use of messaging or file-sharing features;
- •your content;
- •your violations of these Terms or applicable laws.
16. Termination
You may stop using the Service at any time. The provider may suspend or terminate access to the Service for violations, security concerns, abuse, or operational reasons.
17. Governing Law
These Terms are governed by the laws of Cyprus. Disputes will be resolved exclusively in the courts of Cyprus unless prohibited by applicable law.
18. Changes to the Terms
The provider may revise these Terms from time to time. Material changes will be communicated through reasonable notice. Continued use after changes become effective constitutes acceptance.
